08.12.2008 Specialized equipment for Customs control

Client: Ministry of Finance – Customs Agency

Danlex has installed and put into operation new X-ray inspection systems for customs inspection at Port Vidin and Port Ruse. Danlex has delivered and introduced unique for the country special equipment for Customs needs of checkpoint Sofia Airport.

  • The new X-Ray security inspection systems for carry-on baggage on passing passenger’s flow are made by Smiths Detection – Germany. These systems are a contribution in the achievement of an effective customs control in the applying of the World Customs Organization Framework of Standards..
  • Banned Substances recovery equipment – for first time in Bulgaria. This unique special equipment will notably ease customs agent’s work in the fight against illegal drug – traffic.

15.10.2008 Systems for inspection security of baggage and cargo

Client: Public Enterprise for Airport Services (PEAS) – Airport “Alexander the Great”, Skopje

Danlex has put into operation at the Airport “Alexander the Great” in Skopje, new X-Ray systems for inspection security of hand baggage, registered baggage and cargo.
The X-Ray systems cover the requirements for security in the civil aviation and they are produced by Smiths Detection – Germany.
The new equipment contributes to increasing the level of security in the process of attendance of the passengers.

19.03.2008 Security X-ray Inspection systems for incoming control

Client: National Assembly of the Republic of Bulgaria, Sofia

The new systems cover requirements of Special Forces for incoming security inspection and they are the latest generation machines manufactured by Smiths Detection – Germany. 
The new equipment helps for increasing the level of security during incoming inspection in the Parliament’s buildings. In addition, Danlex EOOD gave free of charge computer based x-ray operators training system at Special Forces disposal, enabling initial and periodical supporting training of Special Forces staff  responsible for safety of members of Bulgarian Parliament.

14.01.2008 The Supreme Administrative Court judged in favor of Danlex

The Supreme Administrative Court of the Republic of Bulgaria – five members of judges, with a Court Ruling No.: 170/08.01.2008 revoked as unlawfully the Decision No.: 30/16.02.2006 of the Commission for Protection of Competition by which the monetary penalty was imposedto Danlex for harming the name and trust of the competitor Hyrdoloc EOOD.

Danlex was accused by Hydroloc in violating the art. 31 par. 1 of the Law for Protection of Competition, in the way that some definitions made before the Ministry of Regional Development and Public Works (MRDPW) and Ministry of Finance (MoF), containing false information and submission distorted facts, harming good name and trust of the competitor Hydroloc, as well as distributed by Hydroloc equipment manufactured by Rapiscan company.  

The Court accepted as indisputably established by the gathered proves under the case, that statements, submitted in quoted above letters from Danlex to MRDPW and MoF do not contain any false and do no present distorted facts for the following reasons:

  •  The statement that Hydrolok does not posses license and permit as well as service and technical team for installation, training and maintenance of X-Ray equipment is entirely true.
  • The statement, that Hydroloc will be contractor of the contract without any tender or completion is also true. Undoubtedly, the contract was awarded without any tendering procedure and selection by competent authorities by which, obviously, the principals of public procurement is violated.

The conclusion made by the Commission for Protection of Competition that “…the judgment for the observation of the requirements for public procurement, as well as qualifications and technical requirements, are part of competence of the authority, published the tender, which behavior is subject of Court control in accordance with Public Procurement Act and by competence the economic operator…” is wrong and contradict of the principals of democratic society including of the art. 120, para. 2 of the Constitution of Bulgaria.   The Court deems that Danlex, by approaching for this activities the authorities like minister of finance and minister of regional development, who are directly responsible for observing the fiscal discipline, in fact exercised their rights to be involved in the public and economic process of the country and to alert for infringements the authorities having rights to react in case the signal for infringement is true which is undoubtedly in this case. 

  •  All statements concerning the installed at Border Checking Point Lesovo X-Ray equipment Rapiscan, are correct and supported by the gathered proves under the case. The company in fact does not manufacture such equipment; did not submit proves for manufactured and sold X-Ray equipment of this model; did not submit the document from accredited laboratory for technical compliance of parameters of the model and admission to the market; there is no any compliance mark on the equipment installed at the Border Point Lesovo, this marking the manufacturer is obliged according to the applied normative documents.
  • The statement that supplied by Hydroloc and installed in 2005 at Sofia Airport X-Ray equipment Rapiscan are inappropriate for airports application and unconformities with technical characteristics, as well as the usage is connected with additional unforeseeable costs for the user, are entirely true, according to the submitted under the case proves.

In regard with the stated, the Court accepted Danlex appeal as entirely justifiable and the Court judged decision by which revoked the Decision of Commission for Protection of Competition for imposing the monetary penalty to Danlex and sentenced the Commission for Protection of Competition to pay all court costs under the case. The Decision is peremptory.
